Office flex space is an office taken on a shorter, simpler commitment than a standard lease, usually furnished and ready to use. In real estate more broadly, flex space also names an industrial building that mixes warehouse space with offices, which is not what this page covers. For a startup the practical question is what a New York landlord asks of a company with little financial history: a security deposit of several months of rent, a letter of credit on larger deals, and often a good guy guarantee from a founder. What a New York landlord asks of a young company
A lease is signed by a company, and a young company is easy to walk away from. So the landlord looks for security, and sizes it by credit, not by formula.
- A security deposit. Usually several months of rent. A company without years of financials is asked for more.
- A letter of credit. On larger deals the security is often posted through your bank, as a letter the landlord can call on if you default, which leaves your cash in the business.
- A good guy guarantee. A founder guarantees the rent personally, but only until the company moves out cleanly, with the keys handed back and rent paid to that date.

What a startup can negotiate on a flexible lease
The first number a landlord quotes is its most cautious reading of your credit. Nearly all of it moves.
- The rent, and the free rent at the start of the term.
- The deposit, and a burn-down that returns part of it after each year of on-time payment.
- A renewal option, so a short term does not leave you exposed at the end.
- An expansion right on nearby space.
- The notice period, including the notice that releases a good guy guarantee.
What a young company should have ready before the proposal goes out
A landlord reviews a tenant's credit before it agrees terms, and slow answers to its questions can cost weeks. Have these in hand first:
- A tidy financial package: whatever statements exist, plus evidence of the latest funding round.
- A decision on who would sign a guarantee. One named person is the usual aim, not every founder.
- An answer from your bank on whether it will issue a letter of credit, and against what collateral.
- An attorney who reads commercial leases, lined up before the draft arrives.

Will a landlord lease to a startup that has only just raised?
Landlords do lease to newly funded companies, but nothing obliges a particular one to approve a particular tenant. A recent raise with no operating history reads as higher risk, so expect a larger deposit or a guarantee in exchange. Showing the raise, the runway and a clear guarantor early makes the review quicker.
How many months of rent is the deposit for a new company?
Nobody publishes a schedule. The number tracks how the landlord reads your credit: an established company is asked for less, and an early-stage team can be asked for substantially more. Treat the first figure as an opening position and ask for a burn-down.
Does a good guy guarantee make a founder liable for the whole lease?
No. It covers the months the company is in the space. Once the company has served the notice the lease requires, left, handed the keys back and settled the rent through its last day, the founder's guarantee falls away. The company itself still owes the rest of the term. Release conditions differ from lease to lease, so have your attorney confirm them before anyone signs.
Can part of the deposit come back before the lease ends?
Yes, if a burn-down is negotiated. It returns part of the security, or reduces the letter of credit, after each year of clean payment. Watch the conditions: a schedule that any late payment cancels is worth much less than it looks.
