A sublease is usually cheaper than a direct lease and often faster, with catches. Sublease against direct lease: the honest comparison for a growing team

  • Price. A sublease typically sits 10 to 25 percent below direct space of the same kind, and the gap widens as the remaining term shortens.
  • Term. You get what is left on the original tenant's lease, often two or three years, and its renewal options rarely pass to you. A direct lease runs for the term you negotiate.
  • Condition. A sublease comes as found, usually furnished, with no improvement allowance. A direct lease can come with construction money and free rent.
  • Control. Your rights sit beneath the original lease. On a direct lease you deal with the landlord yourself.

For a team that cannot forecast two years out, the short term is an advantage. What a sublease is covers the structure.

How fast a growing team can move into a sublease

The space is built and usually furnished, so nothing has to be constructed. The variable is consent. Nearly every New York office lease requires the landlord to approve a sublease in writing, and that approval runs to the landlord's timetable: allow about four weeks, and find out early whether the original lease lets the landlord take the space back instead. We send in the consent package the day terms are agreed, and we negotiate a date after which you can walk away with your deposit.

The checks we run before you commit to a sublease

  • The remaining term, set against how long you need the space.
  • The condition, on the assumption that nothing will be repaired.
  • The original lease, read in full, because its rules on hours, alterations and restoration flow down to you.
  • The sublandlord's finances. If it stops paying, its lease can be terminated and your sublease can end with it.
  • The consent standard: whether the landlord may refuse freely or only reasonably, and by when it must answer.
  • Any recapture right that lets the landlord take the space instead of consenting.

Do our listings include subleases?

Most of what we publish is direct space, leased from the landlord. Subleases and floors that are not being advertised tend to reach brokers before they reach any website, so the way to see them is to send a brief with your team size, date and budget. Sublease options then come back alongside the direct shortlist. When a listing on our site is itself a sublease, its page says so.

When no sublease fits: furnished direct floors

A sublease is the wrong answer when the remaining term is shorter than your need, or when the layout fights the way you work. The nearest alternative is a furnished or prebuilt floor leased directly. The speed is similar, usually two to four weeks between signing and occupancy, and you hold your own lease, with terms of 12, 24 or 36 months available on some floors. Is a sublease always cheaper than a direct lease?

No. The discount narrows when the remaining term is long and the space is in excellent condition, and inherited duties such as restoration can eat into it. Price those first, then compare the total cost over the time you will actually be there.

Can we stay after a sublease ends?

Only by making a new deal directly with the landlord. A sublease ends with or before the original lease, and renewal rights rarely transfer. If you think you will want to stay, raise it with the landlord early.

Can a growing team sublease part of a floor?

Often, if the original lease allows partial subletting. Shared entry, pantry and meeting rooms then need to be written into the sublease, and the landlord's consent is still required.
