Yes, a commercial lease renewal is negotiable, and a startup should run its first one like a new deal. The landlord's first renewal offer is usually the same terms at a higher rent. What you can ask for is what a new tenant would get: free rent, money to refresh the space, a reset of escalations and a floor resized to the team you have now. Your leverage is the cost the landlord carries if you leave, and it only works if leaving is believable. That takes time, so start 12 to 18 months before the lease expires.

Tip 1: Start 12 to 18 months before expiry

Renewal leverage depends on time. With eighteen months left you can run a real search, negotiate without hurry and let the landlord weigh the risk of an empty floor. With four months left, everyone knows a move with a custom buildout cannot be done, and the offer shows it.

Running out the clock is worse. Staying past expiry without a signed deal is holdover, and the usual penalty runs from half again to double the rent. Holdover explains why that clause is the landlord's strongest card in a late negotiation. Check whether the lease contains a renewal option. If it does, the window to exercise it can close months ahead of expiry, so find that date first.

Tip 2: Resize before you talk price

A first lease was sized for a company that no longer exists. Count the team you have, add the hires in the plan you believe, and multiply by 175 rentable square feet a person. If the floor still fits within about 15 percent, renewing is on the table. If headcount has moved well past it, or well below, no renewal discount fixes the mismatch, and the conversation becomes more space in the building, less space, or a move.

Tip 3: Price the stay against the move

Build one table covering the same number of years for both outcomes. The stay column holds the renewal rent and its yearly increases, minus the concessions offered, plus any refresh work you would fund. The move column holds the new floor's rent and increases, minus that landlord's concessions, plus construction beyond the allowance, furniture and cabling, a second letter of credit, the movers and a figure for downtime.

Tip 4: Build alternatives a landlord can see

A renewal is priced against your credibility. Tour real floors, take the best one to a letter of intent, and let the landlord know the search is live. Tip 5: Negotiate the package, not only the rent

  • Free rent on the new term, for the same reason it exists on a new lease.
  • Landlord money to refresh the floor you already have: new carpet, paint, a changed layout.
  • A reset or cap on escalations. Over a long extension it outweighs the face rent.
  • A resized premises, or rights to expand or give space back that match the new plan.
  • A term that fits the plan: fewer years, or options to extend.
  • Fixes for building problems you have lived with, which are easiest to get before you sign again.
